Acceptable Use Policy

This Acceptable Use Policy describes how you may use OurDigitalContract and which uses are not permitted. It applies to everyone who uses the platform: the customer, the customer's employees and anyone who views or signs a document through a signing link. This policy supplements our Terms of Service. In the event of a conflict, the Terms of Service prevail.

What this policy covers

OurDigitalContract is a platform for drafting employment contracts and other documents, maintaining personnel files and having documents signed electronically. This policy is about the way you use those functions. The aim is a safe, reliable and lawful platform for all users.

Prohibited use

You may not use OurDigitalContract for any of the following:

• Unlawful or fraudulent purposes. Any use that breaches the law or that is aimed at deception, fraud or other dishonest conduct.
• Signing under a false identity or without authority. Drafting documents or having them signed under a false identity or someone else's identity, or on behalf of a person or organisation without being authorised to do so. Identity fraud in the signing process is expressly prohibited.
• Misuse of signing links. Forwarding a signing link to someone other than the intended signer, or using signing links for phishing or to mislead recipients.
• Malware or unlawful content. Uploading files containing viruses, malware or harmful code, or filling documents and files with unlawful, offensive or otherwise prohibited content.
• Infringement of intellectual property. Uploading or distributing content that infringes the copyright, trademark or other rights of third parties.
• Circumventing security. Circumventing security, authentication or access controls, testing them without permission, or attempting to access the data of other customers or users.
• Automated scraping or overloading. Searching or extracting data from the platform in an automated way (scraping), or deliberately overloading, disrupting or making the platform unavailable.
• Sharing access beyond authorised users. Sharing login credentials or access with people who are not authorised users of your account.
• Reselling without permission. Reselling, renting out or offering the platform or parts of it under your own name without our prior written consent.

Customer responsibilities

As a customer you are responsible for the use of your account. This includes the following:

• You are responsible for the conduct of your own users and for managing their access rights.
• You are responsible for the lawfulness of the content of the documents you draft and have signed, and for having a legal basis to process employee data. We do not determine the content of your documents and do not review it substantively.
• You make sure that the people you invite to sign are the right people and that you approach them in the correct way.
• You handle login credentials with care and keep your account secure.

Reporting misuse

If you notice misuse of the platform, for example a suspicious signing link, a suspected case of identity fraud or a security issue, please report it to us as soon as possible at support@ourdigitalcontract.com. This allows us to investigate and take action where needed.

Respectful use of support

Our support team is happy to help you. We ask you to treat our staff and other users with respect. We do not accept threatening, abusive or intimidating behaviour towards support or other users.

Consequences of a breach

In the event of a (suspected) breach of this policy we may, depending on the seriousness, issue a warning, suspend the account or specific functions, or terminate the agreement. We do this in accordance with our Terms of Service. Where possible we will try to contact you first, but in the case of serious or urgent misuse we may act immediately to prevent harm.

If we terminate for misuse, you are not entitled to a refund of amounts already paid, to the extent the law permits. You can read more about this in our Fulfillment, Refund and Cancellation Policy.

Changes

We may amend this policy from time to time, for example when the platform changes or when new forms of misuse require it. The current version is always available on this page.
