User Declaration

This user declaration describes what you are responsible for when you use OurDigitalContract, offered by Qfile B.V. By logging in and ticking the acceptance box, you accept this declaration. It supplements the Terms of Service and the privacy policy; in the event of any conflict, those documents prevail.

1Authority

You declare that you are authorised to act on behalf of the organisation that gave you access to OurDigitalContract and to accept this declaration. If you act on behalf of an organisation, you bind that organisation to the use of the service and to the applicable terms. If you are not authorised to do so, do not use the service under this account.

2Lawful use

You use the service solely for lawful purposes and in accordance with the Terms of Service and applicable laws and regulations. You do not use the service for unlawful, misleading or harmful acts, or in any way that harms the service, other users or third parties.

3Accuracy and third-party data

You are responsible for the accuracy, completeness and lawfulness of the data you enter or upload. This also applies to the personal data of others, such as employees, applicants, contractors and other signers. You declare that you have a valid legal basis for processing that data through the service (for example a contract, a legal obligation or, where required, consent), and that you have informed data subjects where necessary. You do not process more data than is needed for the purpose for which you use the service.

4Account and confidentiality

You keep your login details confidential and do not share your account with others. Each user works under their own account with their own two-step verification. Actions carried out under your account are attributed to you, unless you make it plausible that they occurred without any fault on your part. If you suspect that someone else has access to your account, change your password immediately and notify your administrator.

5Reporting misuse

If you notice misuse, a security problem or a (suspected) data breach, you report this without undue delay to your administrator and, where applicable, to us at support@ourdigitalcontract.com. This allows us to take timely measures together.

6Electronic signature

You understand that signing through the tool is a simple electronic signature (eIDAS SES). Identity is evidenced through control of an email address and a one-time signing link, and integrity through a tamper-evident attestation and an audit log. This is not an advanced (AES) or qualified (QES) electronic signature. Whether a signature is sufficient in a specific situation depends on the type of document and the circumstances; seek legal advice if in doubt.

7Your own responsibility

You remain responsible for your own documents, templates and processes, and for the consequences of sending them and having them signed. The service is a tool and does not replace legal, tax or employment-law advice. Check important documents before you send them.

8Changes to this declaration

We may amend this user declaration. In the event of a material change, we will ask you to accept it again the next time you log in. If you continue to use the service after an amended declaration, the most recent version applies.
